Vandals / Daily Variety settle

Kung Fu Records has confirmed that The Vandals have settled their lawsuit with entertainment industry trade magazine The Daily Variety over the band's logo. The design of the group's logo on their latest album Hollywood Potato Chip parodied that of The Daily Variety, who served the band with a cease and decist order in September. The band has since gone back and redesigned the logo on the cover art. It will appear on all future pressings of Hollywood Potato Chip. Head to their website to check it out.

pussed out? we're not talking about the offspring here......the vandals are a hard working band who don't have the resources to waste money on a lawyer just to prove a point... so they did what any rational person would do....they settled and saved themselves a load....

In a suit, a parody defense is not always easy to make, as it requires that the allegedly infringing use makes some kind of critical commentary or transformative use. I think it would hard for the Vandals to make a very convincing argument that the use of the logo design is making some kind of obvious critical commentary, though not impossible. Remember though - no suit was filed, and the costs of fighting a suit are often prohibitive, even if you have a lawyer in your band! This settlement looks pretty fair, and nothing I would call a "pussing out." It's not like The Vandals have to destroy all current unsold copies with the original art (destruction is often a remedy in trademark issues). The convenience of changing the art in the next pressing is a far more amicable option than spending a lot of time and money fighting against a company that has the resources to pursue a re

Hate the new lettering. They should have just used one of the old Vandals logos as opposed to those ugly, blocky letters.
