Someone finally realized that university students are also allowed to get assistance from lawyers as news has come in that The Oregon attorney general's office is investigating the Recording Industry Association of America's practices regarding 17 University of Oregon students accused of copyright infringement. While the AG isn't minimizing the seriousness of copyright violations, his office has submitted a brief questioning the data mining tactics and subpoena practices employed by the RIAA.
The office is pushing to essentially cross-investigate RIAA representatives to ascertain the legality of its investigative practices--a discovery request that could be very expensive for the RIAA to respond to. The AG's motion asked the court to allow the university to determine whether the RIAA does, in fact, possess no additional information with which to identify the 17 John Does, and seeks to quash the plaintiff's subpoena as "overboard and burdensome." The RIAA has famously swamped University's and ISP's with "John Doe" requests, demanding identifying information using only IP addresses. IP addresses are used by any person connecting to the Internet, but often change, making the practice less than foolproof. Games and Technology (67 comments)

So.. two nerd comments here..
If you came to me and told me that "IP address 192.168.2.34 @ 7:00PM, who is it". It's not hard to figure out who it is. When we automatically are assigned an IP address, it's through DHCP which is a central server that tells you your IP address. DHCP servers keep logs of the "leases" it assigns of IP addresses to computers MAC addresses (Built in unique identifier for your Network Adapter .. wireless or ethernet). If my network requires you to log onto it, then your log in is recorded along with your MAC address. So I can then search those logs too. First I figure out what MAC address was assigned that IP address at that time, then I search that MAC address against my Log In records. If there is no log in record, I can trace the sale of that PC fairly easily through the manufacturer. However, if the RIAA has been sue show rest of comment

theyre fighting the tactics they used in these specific cases, not file sharing itself. although this will no doubt drain the riaa's money even more, so GO!

I don't download via bit torrents, etc because the last thing I need is a fucking lawsuit. I know the chances are slim, but I don't want to risk it. Besides, I like supporting indie bands and indie record stores. For example, I just bought a FODM cd (archaic I know!) at newberry comics. So has all this RIAA bullshit affected others here in the same manner, or am I one of a few ethical, paranoid peeps here? 2+ Replies
