Victory responds to Thursday

us with this latest piece of label/band drama. This has been floating around for a few days but I've yet to pin the origional source on it. If someone knows where it came from in the first place, please let me know...

"It is regrettable that the members of Thursday wish to voice their imaginary grievances with Victory Records on the Internet and in the press. Victory has fully lived up to its agreements with the group. Thursday has breached those agreements. The members of the group have resorted to misrepresentation and unwarranted character assassination in an attempt to justify retroactively their improper signing of a recording agreement with Lyor Cohen at Island/Def Jam, one of the Universal Music Group labels."

Numerous bands have claimed improper treatment by Victory, Tony most of all. I can't speak personally cause I was never in a Victory band, but these allegations make me was to shy away from any deal Vicotry may ever offer me. you guys fucked up. I will get a new name soon.

how can a grievance be imaginary? i could see maybe incorrect or misguided, but imaginary doesn't cut it for me. the grievances of thursday however right or wrong are real.

I think this says enough about Victory right here... Director of U.S. Publicity???????? Give me a fucking break. Why the hell does a label need a director of U.S. publicity? Tony should respond to these things himself seeing as he is owner and head of the label. I say that that alone says enough about Victory as a label.

Actually i think that there's a real reason why the so-called "Director of US Publicity" responded. I think that Victory wants to treat this whole Thursday situation as nothing of any importance. By not responding to Thursday's post directly, Tony is trying to show that the allegations are such bullshit, that there's no real point in trying to respond directly to them. I think he's trying to avoid another Midtown/Drive-Thru situation for his label. The response of Drive-Thru in that situation was wholly unprofessional, and Tony, as the true businessman, wouldnt lower himself to that position. Instead what he did was very businesslike. Get another senior level officer to issue a statement dismissing Thursday's claims. The businesslike way of saying "Fuck her. I dont need her. That bitch is crazy anyways!"

True, but it's not like Thursday was talking shit about the label like Midtown was to DriveThru. Thursday was outlining the situation for their fans so the fans knew what was going on. A lot of people would be curious about why they signed to a major. I'm sure plenty would be angry too. -Scotty

Thursday sucks balls anyways, so fuck 'em. They will sign to a major label cause they had a bad video played a few times, sell shit for records and get dropped.

Victory's press release fails to explain why Thursday's signing to Island was improper. Based on Thursday's statement, their signing to Island was permissible under the terms of their contractual agreement with Victory. If it wasn't, personal gripes as insignificant as those expressed by Thursday's statement are unlikely to give sufficient legal justification for the termination of their relationship with Victory. Although I'm not a fan of Thursday, it sucks when a band gets caught in a legal battle between companies - so hopefully what's been reported is nothing more than face-saving rhetoric. Either way, the moral of the story is: when signing a record deal (if you are ever so lucky), be sure to plan for the future. Disputes happen, but if you're in the "biz" not liking someone's tactics or attitude is a luxury you don't get.

Am I the only one that thinks Thursday are being a little over-sensitive about the whoopee cushion thing? Boo-fucking-hoo, they handed out some whoopee cushions with your band's name on them. I'm sure they had the worst intentions in mind when they did such a thing. They OBVIOUSLY weren't trying to get your shitty band some cheap publicity. Geez, emo bands these days..

I think they have every right to be offended about the whoopee cushion thing. It is not a promotional action that would effectively represent the group and with the incredibly serious attitude they take to their music, I could see them being seriously offended.

remember the face to face/dr. strange thing? the only way a band can control the behavior of their label is through some kinda binding agreement... hence, contracts are important.

Now, is it me, or was that bit of info irrelevant from a legal standpoint? The idea with that seems (to me) to be put in strictly so people will start saying that Thursday sold out. As if any of us were deluded enough to believe that Island/Def Jam was an independant label. Furthermore, as I've come to understand it, lots of groups seem to have ... erm... problems with Vicory Recs. Either all these bands suffer from persecution complexes, or perhaps *gasp*, there actually is something to it.
