Travis Barker sues Rockstar Beverages

Blink-182 and Plus 44 drummer Travis Barker has reportedly filed suit against Rockstar Beverages and their product, Rockstar Energy Drink.

According to the suit, the Rockstar Web site published a photo of Barker "holding a can of one of Rockstar's beverages, and identifying him and his endorsement by name" without his consent. The lawsuit claims invasion of privacy, unfair competition and misappropriating his likeness to promote the product. Barker is "a prominent figure in the rock music world," according to the lawsuit, which seeks unspecified punitive and statutory damages.

Rockstar has been busy with a number of projects including sponsoring events like the Warped Tour and Kevin Lyman's upcoming Rockstar Mayhem tour.

I haven't seen critics say that they didn't understand the ending or thought it was too weird. I don't see that at all. I have seen some critics say that it was too over the top and just got too ridiculous, which I can see, though I enjoyed it tremendously.

That said, I have seen some critics (and a lot of internet moviegoers) whine about the ending of No Country For Old Men, but not maybe so much because they didn't understand it- just that they couldn't understand why a movie might opt to do something different rather than a "satisfying showdown" ending.

Oh. You really should.

I liked it more than No Country and would only give the slight edge to There Will Be Blood because of its massive scale as an epic, how beautiful the shots were, etc.

But in terms of ferocity, emotion, writing, and acting- Before The Devil is right up there with Blood. Though, unlike Blood, Devil is a completely joyless movie. Just completely draining and without the slivers of humor of No Country. I'm not sure a movie has ever quite captured a building dread like Devil where the world is crumbling in on you. The acting is incredible with each character doing a lot, though, admittedly, looking miserable and not having anywhere near as much fun as Daniel Day-Lewis.

Well the shitty porn is the main problem. My main issue is that they go into bars find drunk girls (or worse yet, they've admitted to buying sober girls drinks to "loosen them up", even underage girls) seeking validation and then videotape them, and sell it. Yes, the drunk girls sign a waiver but they aren't of sound mind. Then they only allow the girls 24 hours to call in if they wish their footage to not be used. Usually, they're too embarrassed to be confrontational in the first 24 hours.
Add to it that the guy who founded the company has been accused of sexual assault and rape and you have a quality company.
I don't have a major issue with porn. What adults do is their business. But Girls Gone Wild is one step above date rape.

Taking away the personal accountability that these girls have for drinking responsibly makes it seem like they are weak and can't make their own decisions. You're trying to punish the majority for the actions of the minority.

You're projecting a perception that all the girls go to these events are in capable of acting responsibly. And that the guys who attend said events are fierce predators. Is this true in some cases? Yeah, it sure is and that's wrong. Is this anywhere near the norm? No, it certainly isn't.

Are you really trying to say that the adult women who attend these events are not aware of the fact that there will be copious amounts of alcohol and a number of misogynistic guys in attendance? Welcome to any club in any major city. You can't just remove all the personal responsibility from the situation.

This is only one situation out of a million. Try switching the gender roles around and see if you react the same way.

Yes everyone is responsible for their own actions but a lot of these girls are 18, and 19 (and I do believe an angry father found his 17 year old daughter in one of their videos). Whether or not you choose to accept reality, that is an awkward age, and that effect is only enhanced by the copious amounts of alcohol that these fucking pigs - in most cases illegally - pour down their throats. These girls are taken advantage of by sexual predators, and if you can't see that you need a big wake up call.

Your first paragraph missed the point by so far that I'm not even sure we're talking about the same thing. My girlfriend is a double major in Sociology/Psychology with concentrations in Cross Cultural Sexuality and Gender Studies. I highly support this and talk with her/learn from about such issues quite often. I probably am more familiar with the situations you describe than you give me credit for.

Let me tell a story. This is 100% true, by the way.

I'm not punishing a majority, I'm taking one specific instance. I don't care if people go to clubs get drunk and screw. But when your a professional film crew who has the job of intoxicating women and coursing them out of their clothes it's a different story. These aren't isolated incidents like, "We went to a bar and whoops! How'd that happen". These are people who set these things up and then stalk out girls, and persuade them to do this.
Look at it this way:
If there was a guy who habitually went to bars, got some girl drunk (while not drinking at all himself) took her home, had sex with her, videotaped it and showed everyone. Would you look at that guy as just some dude or a sexual predator? Add to it, that this guy then sells the tapes. Really that's their job? Because I was under the impression the 25 girls who are up on stages flashing the camera while downing their drinks got up there on their own capacity. Now I'm not terribly familiar with the videos, just the commercials I've seen. So if I'm wrong about the format, then I'm sorry. Even so, that's basically peer pressure. I think you'll find that those with feminist leanings who aren't categorically opposed to porn, but just certain kinds, tend to have a problem with films that are verbally abusive, using misogynistic terms (guys calling girls things like cunt, bitch, slut, etc. while they have sex) and films that end with guys ejaculating in women's faces. They see it as really disrespectful and demeaning, which, of course, it is (I've never quite understood why that is the industry standard). But that said, a lot of these types are pro-porn that shows an equal and supportive power dynamic between men and women and think it's great. And I can see that argument.

Porn, of course, isn't a grand social issue or lightning rod. What it is, however, is a microcosm of the mindset that the world feels free to view women with. Not bothering to think about the things you masturbate to is a lot like not thinking about the foods you eat or the clothing you wear. You want to be so keen as to know the labels your music comes from to not support the RIAA because they crush freedoms or whatever the fuck. Yet, when it comes to discussing your foods or your porn, you turn away and say "It's not my worry, too small." Take care of the pence and the pound will follow. In other words, deal with these small issues and resolve them at the source and the larger issues of things like sexism will fall in line.

It wasn't a cry-fest; it's just obnoxious when people get all bent out of shape regarding other posts and respond to someone else with something that isn't actually a response (attacking me for a philosophy that I was describing, rather than pushing, while also lumping what I said with other people on this posting and with your own personal experience hating feminists). First of all, this is not something that I ascribe to, but I think the general thought would be no one is saying that in the private sphere, you shouldn't do whatever you want during consentual sex with a receptive partner. Yes, the guy is an obvious douchebag and has allegedly done some very bad things. And I feel for the underage girls who have been taken advantage of. That's unethical and wrong and he should be punished.

But there's also a level of personal responsibility here. I'm sick and tired of people using alcohol as a scapegoat for everything just because it's a socially acceptable excuse. I've visited a friend at one of the schools they have filmed that stuff at, and I can tell you that most of girls that attend those events know exactly what kind of situation they're getting themselves into. Frankly, it's kind of an insult to the girls who attend the events to just assume they are all victims or being taken advantage of, like they can't handle themselves responsibly if they choose.

This is an open and shut case. Rockstar Beverages holds the copyright on the term 'rockstar', meaning that they have the rights to anyone that can be branded with that label. An unwise move by Mr Barker was stating that he is, in fact, "a prominent figure in the rock music world." If Rockstar Beverages can effectively convince a jury that this qualifies him as a rockstar, case closed.

That interview sort of made me lose respect for Travis Barker, but I suppose if you don't know Nardwaur's shtick, it could come off as someone trying to fuck with you. Plus his questions concerning Rob "being down with hip hop" and the shampoo commercial were a bit antagonizing.

Oh. I bet it is. I mean, advertisers know what works and companies want to advertise effectively. I never said it wasn't.

But it seems like people (or the estates of people) who are "big" enough iconic figures (though I'd stop short of calling Barker iconic, but certainly some of the others) to have companies wanting to use their image in advertising are going to have someone catch it for them fairly quickly and bring a suit. Maybe these companies do a cost / benefit analysis ahead of time and figure it still puts them ahead to run the ads and risk having to stop run them and face a suit, but it still seems like they are pretty likely to get called on it. That's all.

Sidenote: I'll admit that the Rolling Stone thing is a little different, in terms of what it was (it was a large pictoral of the rock universe put together by the music magazine's staf

The porn industry is so sleazy because there is very little regulation in it. We can sit and argue all day on the moral merits or the ethics of porn. But guess what, at the end of the day there will still be people videotaping a guy fucking a girl and selling it for profit.

If people could get off their moral high horse and start accepting that some things are out of their control, then some sensible regulations could probably go a long way in cleaning the business up. Because remember, it is a business. A wildly lucrative one.

Prostitution should also be regulated.

See, this I agree with. I have no issue with porn. If two people consent to having sex on camera and a dude films it, I think that's fine. I also agree their should be more regulation. It's come a long way from the late 70's but certainly it could be safer.

I differentiate porn and GGW, because GGW preys (repeatedly) on people who aren't in the best mental state. Some porn does the same (poor people, drug addicts etc.) but increased regulation could actually help improve that.

Though one could argue that you're still funding the system, if you accept that free online porn exists because of the high traffic it draws and the advertising revenue that that creates. Watching free online porn provides the demand that determines the supply.
