Love Equals Death parts ways with Dominic Davi

Love Equals Death have parted ways with bassist Dominic Davi in light of his recent arrest. In late March the ex-Tsunami Bomb member was held on charges relating to the alleged rape of a Virginia woman in June 2006. The band posted:

Some of you may or may not know that Love Equals Death was dealt quite a blow about three weeks ago when we had found out that our bass player was facing serious charges. Well, we would like to make it perfectly clear here at camp LED that we do not in any way condone any such behavior related to these charges. We, however are not a judge or a jury and don't want to be one any time soon. We are however a band that really just wants to continue playing music. We know that these times have been severley trying for Dominic(bass player in question) and the accuser. We hope for the best outcome for all parties. However, Dominic will no longer be playing music or working on behalf of Love Equals Death. This matter that he faces requires all of his attention right now and we (Tonio, Duffs and myself) wish him well as I know all of you do. I personally know that his love for music will always keep him in the scene and i'm sure those who support him will be seing him around very soon. This is an official statement from me to all of you. We will announce a new bass player in the next few weeks and we'll see you at the next show.

The Petaluma, CA band released Nightmerica in 2006 via Fat Wreck.

The unfortunate thing about serious charges such as this are, even if the accused is found to be not guilty, it has a way of destroying their career.

But yeah, the band seems very careful with their choice of words. If the accusations were false, the band would be coming out strongly in support of Dominic. This doesn't seem to be the case.

Actaully Dom is a very good friend of mine and I can't come right out and say it because of the court crap.. but I wil lsay she has no case. Dom is not guilty and he got kicekd off because his band is shady and doesn't want any bad publicity. If it were a good band then they would stand behind their band mate and support them but they are jsut in it for the $$.. Sad..

Love Equals Death is not making a lot of money. If you're a good friend of Dom's, you know that. So don't just use that as an easy, satisfying explanation for the band's response.

They probably aren't standing behind him because they know something happened.

They are not making a lot of money. They were about to make more though. You might have noticed the publicity they got from that recent little tour with AFI. It's not about what they've been making. Bands make money off of royalties. Frankly, this kind of scandal could have done wonders for their sales if they were already secure financially. But because they are on the brink of success, not the apex of it, they're in a far more tenuous position in terms of PR and subsequently money. The band is well aware of this. Hopefully that's a more complete answer for you. I was an A&R for a major label for two years, but that's immaterial. Point being that I'm fairly certain they were about to do much better and they're aware of how this could prevent them from that. Primarily due to online publicity like this.

To clarify, I don't believe it's dumb, it's pretty serious for those involved: the girl, the bass player, the band and the fans (of which I am not one), no matter what the real case is, their whole situation just got severely fucked up.

And when I said drama (or actually, "drrrrrrrrrrrrama!"), I meant it to be more in the theatrically entertaining for an outsider sense, not the melodramatic kind.

This sounds to me like sort of a polite way of saying "we can't have a rapist in our band".
I think if I was certain that someone in my band was being railroaded with bogus rape charges I'd stand by him and certainly not kick him out of the band. It's sort of damning that they don't want to work with him anymore, I imagine they would know him pretty well and if they think it's plausable the charges he's facing hold water, that has pretty heavy implications.

You're either lying about false accusations of rape (most likely), you don't know what the definition of rape is (probably also true), or it's a freak coincidence.

Almost always siding with an accused rapist. Awesome, dude. Blame the victim. The law does presume innocent until guilty, but rape is probably the most emotionally involved crime one can be a victim of. I hope you never know a woman (or man) who gets traumatized by rape and spends years of their life in fear, only to have people they thought they could trust laugh in their face and call them liars.

Coercing a drunk girl into sex when you are sober is considered rape in most places. According to Virginia law:

"A. If any person has sexual intercourse with a complaining witness ... (ii) through the use of the complaining witness's mental incapacity or physical helplessness..."

If you are sober and she is drunk, you have (temporarily) greater mental capacity and physical command, and courts have interpreted this law to convict people in such instances.

I'm not blaming the victim for having sex, I'm blaming them for being liars because they know that they'll get sympathy, seeing as rape is truly a terrible thing. I don't think it's quite as comparable, but spending your whole life with a reputation as a rapist because some girl decided she made a mistake probably isn't the greatest thing ever either.

From what I've seen about the case, I think this girl is one of the many that decided to lie about something as serious as rape. Doesn't mean I hate girls that get raped, but the ones who cry wolf certainly don't make me rush to believe the real victims.

So many victims are afraid to speak out because of people scrutinizing them or calling them liars. By criticizing the victim, you're putting them in an even more emotional and traumatic state, thus silencing people who would otherwise have the strength to speak out about rape.

That's right, and that's exactly why many women are so great at lying about being raped. I'm not saying I believe this is the case here, but I'm sure some of you know of a female who got incredibly wasted one night, slept with a few guys and later claimed rape using alcohol to justify her regrettable actions. In that case, when it all boils down to he said/she said, it's motivatiing to let the tears flow when there's a massive pay off in the end. If I was going to trial with accusations of raping someone, you can bet that making sure my bass playing is decent would be pretty far down on my importance scale. He's simply not going to be able to represent the band the way he should be, and for that I can't blame the band at all. Actually, you can have someone arrested for rape on next to no evidence. However, he has not been arrested for rape at this time. He was arrested for missing a warrant, I can't recall the technical term for it. It hasn't gone further yet due to a lack of evidence. His girlfriend is very supportive of him, as are all the people in his life. He's someone with a great deal of magnanimity and has done many good turns for others. The allegations bother her, in that they are allegations at all and are disrupting their lives. She knows well what occured. They're now both suffering for the improper decisions made by this girl.

Dom never left California, he has not been extradited across the country. It is a legal technicality that they have to take you in for questioning when you're accused of rape. He was held in CA for a week while his family was scraping up money for bail. Philly detectives haven't even evaluated the charges yet at all beyond taking down the accuser's claims.

I have known Dominic personally for almost ten years, the man would not harm a fly. He is one of the most respectful, especially of women, people I have ever met. To judge him based on an accusation is horrible.

Put yourself in his shoes. Pretend someone who you don't know accused you of a horrible crime. Then determine how you, your family, and your friends would feel if everyone just assumed you were guilty and cut you off.

We live in a country, fucked up as it may be, that has always believed that a person is INNOCENT until PROVEN GUILTY.

I believe there's more than meets the eye to this case and that Dom's friends, from whom that list was compiled, are aware of what those elements are. Not that they can repeat them. You will notice support from those who live close to him, with him, former band members, people he had contact with during that time, family members who have been in court with him, and friends.

No one has to presume he's innocent. I know he is. I know the story and I've read the emails. There is no case.

Not only did I see the letter from her, but I saw the warranted information from the detective. I can promise you that whatever Dominic has shown you is a false letter in hopes of getting your support and cash.
While the victim is certainly a friend of mine, the investigators are not and I have been working closely with them. This will not turn into a he said she said, Dominic admitted to rape in the actual letter. If he concocted something fake and vague, I wouldn't be surprised as there are a lot of people saying they have seen the letter and that it says nothing about rape. Well, the letter that authorities created a warrant over and arrested him for did. If you are such a strong supporter, please come to court where you can see real evidence, because there was NOTHING VAGUE about this admission of rape.

To me, this is a perfectly normal decision by the band. You never know, maybe Dominic himself wanted to focus his attention on clearing his name.

For all of you who are suggesting that the girl is lying, who are you to say that? You don't know what went on any more than the band do. Whether he's guilty or not, they have their own careers to look after, and can't be tied down by a possibly lengthy court case. I'm sure they'll be supportive of him regardless of his involvement with the band.
