As you may recall, last year the Beastie Boys won $1.7 million in damages from Monster Energy Drink after the beverage company used samples of the band's music in advertising materials without the band's consent, and following an explicit statement in Beastie Boy Adam Yauch's will stating that he did not want any Beastie Boy music used in a commercial. Monster may have also given away an online mix of the band's music without the band's permission.

Ever the class act, Monster stated that it would seek to over turn the jury's verdict of $1.7 million awarded in damages. Perhaps as a response to Monster's refusal to accept the jury verdict, the Beastie Boys have moved in for the kill. As of this week, the Beastie Boys have filed an application to the court requesting lawyer fees and costs in the amount of $2.4 million. In the filing, the Beastie Boys stated "Monster's tactics significantly increased the costs for Beastie Boys to vindicate their intellectual property rights, such that, absent an award of attorney's fees and costs, plaintiff's success at trial would become a Pyrrhic victory."
